1.1. In these Terms and Conditions when we say:
A) You / Your, we mean you, the individual interacting with Keymer Health content and/or ordering and purchasing Products;
B) We / Our / Us, we mean KEYMER LTD. We are a limited company registered in England and Wales at Companies House. Our registered administrative office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. We are a registered company at Companies House, and our registered company number is 13345303. D) Products, we mean the products which are available for purchase on the Website;
F) Contract, we mean any contract between You and Us for the sale and purchase of Products incorporating these Terms and Conditions.
1.2. By using this website and/or purchasing Keymer Health products, you confirm that you agree to the terms and conditions set forth by this document. If you do not agree to these terms, you are not permitted use the Keymer Health website, purchase Keymer Health products, or utilise Keymer Health services in any way. 1.3. This End User Licence Agreement (“Agreement”) is a binding agreement between you (“End User” or “you”) and KEYMER LTD (“Company”). This Agreement governs your use of Company’s supplements, CBD oil, online articles, meditations, nutritional advice, digital content, website.
1.5. This Agreement shall be governed by the laws of England & Wales. No one other than a party to this contract has any right to enforce any term of this contract.
1.6. You may not transfer your rights under this Contract to any other person.
1.7. We may transfer any of Our rights under the Contract to any person or ask any person to fulfil any aspect of it so long as the performance of the Contract is not affected.
2.1. KEYMER LTD provides a variety of media content for informational purposes in the form of written articles, replies to comments, videos, podcasts, vlogs, social media posts, images, charts, books including ‘ebooks’, and in product descriptions.
2.2. Keymer Health content creators aim to cite scientific claims where possible. We make no comments on the legitimacy of the studies or research enclosed. In situations where research suggests individuals use a product that is sold by KEYMER LTD, this is not to be considered as a personal recomendation or advertisment to you. Your registered GP or healthcare provider can recommend supplements, dietary changes, and life changes, as only they are fully aware of your medical history and possible contraindications.
2.3. The content on our website is not medical advice (diagnosis or treatment) and is provided for general information and educational purposes only. It is not intended to amount to personalised medical advice on which you should rely.
2.4. Although we provide information about our products on our website, neither our employees or any third parties referenced on our website are authorised to provide medical or other professional advice through our website. We also have not confirmed the qualifications of any third party referenced on our website, even if the qualifications of that third party are listed.
2.5. You should never use the information you obtain on our website for the diagnosis or treatment of any health problem or in place of any medication or other treatment prescribed by a physician or other healthcare provider.
2.6. Please consult with your doctor or other healthcare provider if you have health-related questions before using any of our products or relying on any information you obtain on our website. 2.8. You accept that there is no attempt on the behalf of Keymer Health to decieive or in any way mislead readers and/or viewers. You understand that due to the nature of creating content based on complex and evolving topics, mistakes or out of date information may be posted. Keymer Health posts content that is accurate to the best knowledge and accuracy of the publisher.
2.9. Keymer Health does not seek to replace advice from your doctor, and makes no claims to be medically trained to give personal diagnosis.
2.10. You are not permitted to copy, mirror, scrape, download, upload, or host Keymer Health content unless explicitly permitted by KEYMER LTD. If you would like to publish the work of our media content in any form, please first get in contact with our support team.
3.1. Keymer Ltd curates products from professional manufacturers across the world and always strives for the best quality available. Keymer Health products are tested to ensure that they meet UK & EU regulations and quality standards. Keymer Health supplements, CBD products, & bodycare products are manufactured by professional third party sources, and we do not have in house production. Due to this, it is possible that some products may get damaged, mislabeled, or otherwise comprimised without company’s knowledge. By purchasing products from KEYMER LTD you accept this possibility. If your product arrives damaged, or you suspect that your product has been tampered with, please contact us immedietely and do not use the item. Customers are entitled to a replacement product free of charge upon us receiving your returned product(s). For more information please see our returns policy.
3.2. We will provide information on product pages about the product details including country of manufacture, packaging materials, and weight. This information will be as accurate as possible by our knowledge.
3.3. Allergen advice is listed on product pages under the ‘Allergy’ tabs. Please refer to this information before purchasing a product. By purchasing and using a product, you accept that KEYMER LTD is not responsible for any adverse reactions that may occur from you consuming a product containing elements that the user is allergic to. If you suspect you may be allergic to any of the contents of a particular product, we advise you do not purchase the product.
3.4. The information We provide about our Products (including any content on Our Website) is not medical advice (diagnosis or treatment) and is provided for general information only. This information is not personalised advice on which You should rely. We are not authorised to provide medical advice. Product information should therefore only be used as a guide to better understand the content of our product.
3.5. You should always consult your dedicated doctor or healthcare provider before taking a new food supplement.
4. User Accounts
4.2. It is your sole responsibility to monitor and update your Account. By creating an account on Keymer Health, you agree to keep your information accurate, complete and up to date.
4.3. You must ensure that your username and password are kept secure and confidential. You are responsible for any activity on your Account and, it is the responsibility of the user to control access and maintain the security of their account. This includes regularly updating passwords, choosing strong passwords, keeping passwords safe, monitoring your devices for spyware/malware, and restricting access to the account on shared devices. It is not the responsiblity of KEYMER LTD to carry out these tasks on your behalf. If you suspect that your account’s integrity or security has been comprimised in any way, please contact our support team as soon as possible.
4.4. Keymer Health accounts have a profile section in which users can easily view a history of their reviews, comments, and order history. User profiles are private and can only be viewed by the user that is logged in to the account, and any site administrators.
4.5. When creating an account, users will be asked to create a username. This username can be found in the URL on the profile page. Due to the way Wordpress databases are handled, this username cannot be changed. Users can however, create and select a ‘Nickname’ from within the ‘Settings’ tab. After choosing a nickname, this can then be set as a display name, which will display alongside your profile picture on reviews and comments. By default, your username will also be set as the display name for your account.
4.6. When posting reviews on products or commenting on articles, you give permission for your profile’s display name and profile picture to be displayed publicly on the Keymer Health website. This data is public and is visable to anyone viewing the page. We therefore recommend that you choose your display name and profile picture carefully to avoid sharing sensitive data. Users can change their display name through the ‘Settings‘ tab in their account portal.
4.7. Upon account creation, a randomised profile picture from our stock photo library may be assigned to your account. This process ensures that profiles have images that are suitable dimensions for our software. If you would like your profile picture changed, this can be requested through our support system.
4.8. User accounts display name and profile picture must not;
A) mention any third party or personal information regarding a third party; or
B) any third party trademark or logo; or
C) third party products and/or websites; or
D) impersonate someone; or
E) reveal the private or personal information of a person other than the account holder.
4.9. Users have the option from within their account control panel to request an information package of their personal data via the Personal Data tab in the account section. This option generates a downloadable file which showcases all the data associated with your Keymer Health account.
4.10. Users can request a total and complete erasure of their account and associated data from Keymer Health servers. This option is found in the account settings, under the tab titled ‘Delete Account‘. Upon account deletion, all instances of your personal information will be permanently removed from our database. If you decide to delete your account, please be aware that all data including order history, comments, reviews, and downloadable content will be removed permanently. Be aware that once user data is deleted, it will be unrecoverable even to administrators. By selecting the option to delete your account and associated data, you accept that KEYMER LTD is not liable or responsible for any circumstances in which such data loss leads to financial losses or damages to you or any other party.
4.11. KEYMER LTD reserves the right to terminate user accounts at any time if they are reasonably deemed to have broken the terms agreed in this document, with particular reference to the rules provided in section 4.6. If we feel that a user has broken the terms of this agreement, we will first seek to contact the user via the contact information provided in their account details.
5. Product Reviews
5.1. Product reviews submitted for publication must not:
a) mention any third party or personal information regarding a third party; or
b) any third party trademark or logo; or
c) third party products and/or websites; or
d) include any private personal information about yourself; or
e) refer to the price of the product (or promotional pricing in relation to that product); or
f) be a review of the customer service that you have received from us; or
g) be a review of the delivery service you have received.
5.2. We will consider your product review before it is published on our website and we reserve the right at our sole discretion to withhold publication, refuse publication or edit any product review that you submit.
5.3. In the event that your product review breaches the requirements of Clause 5.1 of these Product Review Terms, your product review will not be published on our website. The decision as to whether or not your product review breaches the requirements of Clause 5.1 of these Product Review Terms will be at our sole discretion. We reserve the right to remove your product review(s) without notice.
5.4. In appropriate circumstances and at our sole discretion, if your product review is withheld under these Product Review Terms you may be given the opportunity to resubmit an amended product review. In such cases, you will be contacted using the email address provided during the Account registration process.
5.5. Whilst we aim to publish product reviews within 72 working hours, there may be instances where it could take longer. You will not receive a notification of publication or if the Product Review has been rejected. Product reviews will remain published on our website for as long as we consider them relevant.
5.6. Any product review that you upload to our website will be considered non-confidential and non-proprietary and you grant us the right to use, copy, modify, host, distribute and disclose to third parties the product reviews without the requirement of any permission from or payment to you or any other person or entity. We also have the right to disclose your identity to any third party who is claiming that a product review submitted by you constitutes a violation of their rights (including their intellectual property rights or their right to privacy).
5.7. Without limiting the preceding paragraph, the product reviews provided by you may be used: (i) by us to promote our products and business; (ii) to help us develop and improve our products; and (iii) for the purpose of performing business and data analysis, and you grant us the right to use, copy, modify host, distribute and disclose to third parties the product reviews for these purposes.
5.8. You can request that your product review is amended or removed by contacting our support team.
6. User Comments
6.1. Registered users may post comments on Keymer Health articles and posts. Posting comments on articles will publicly display the users profile picture and display name in the comments section, as well as information regarding when the post was made.
6.2. User comments must not;
a) impersonate any other person or party; or
b) conduct yourself in a vulgar, offensive, harassing or objectionable manner while using our website; or
c) contain any copyrighted or trademarked material from a third party without their consent; or
d) reveal sensitive or private data about another individual or third party; or
e) be vulgar, offensive, or liable to cause substantial emotional distress to another individual; or
f) be spam, phishing, or contain links to malware; or
g) knowingly contain false information, disinformation, or be deliberately misleading; or
h) threaten the safety or wellbeing of another individual or user.
6.3. Users can vote for comments via a ‘Thumbs Up’ or ‘Thumbs Down’ button. It is not the responsibility of KEYMER LTD to monitor, adjust, or otherwise change these ratings.
6.4. Users are able to reply to other members in comments sections. User replies are also subject to the rules in section 6.2.
6.5. Users can manually remove their own comments at any time. Please be aware that comments posted publicly may still be available in internet archives such as ‘The Wayback Machine’ or through screenshots. By posting a comment, you accept that KEYMER LTD is not responsible for the tracking, removal, or erasure of such content.
6.6. A history of all the comments associated with an account can be found under the ‘Comments’ tab in the users profile page.
6.7. KEYMER LTD and it’s employees reserve the right to remove, edit, or hide any user comments that are reasonably deemed to be in breach of the terms and conditions of this contract.
7. License Restrictions
7.1. End User shall not:
A) Copy, reproduce, republish, upload, post, transmit, or distribute in any way KEYMER LTD’s content without Company’s written permission, other than as expressly allowed by Company; or
B) modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the content or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of Keymer Health content; or
C) remove, delete, alter or obscure any trademarks or any copyright, trademark, patent or other intellectual property or proprietary rights notices from Keymer Health content, including any copy thereof; or
D) rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer or otherwise make available the content to any third party for any reason, including by making the content available on a network where it is capable of being accessed by more than one device at any time; or
E) circumvent, disable or otherwise interfere with security-related features of the content or features that prevent or restrict use or copying of any Content, or enforce limitations on use of the Content; or
F) transmit through, in or by the content, any software or other materials that contain any viruses, worms, Trojan horses, defects, date bombs, time bombs or other items of a destructive nature; or
G) use any data scraping, mining, robots, spiders, or similar data gathering and extraction methods within the content or in any way reproduce the presentation of the contents without the Company’s prior written consent; or
H) use any “hidden text” without the Company’s express written consent; or
I) interfere with the servers or networks connected to our website or to violate any of the procedures, policies or regulations of networks connected to our website; or
J) take any action that imposes or may impose (in Company’s sole discretion) an unreasonable or disproportionately large load on Company’s (or Company’s third-party providers’) infrastructure; or
K) duplicate or create multiple user accounts in an attempt to circumvent Company’s security and privacy measures and policies; or
(L) “Frame” or “Mirror” any part of the content; or
N) use our content or products for any unlawful purpose; or
O) resell, sublicense or export the software associated with our website; or
P) impersonate any other person while using our website; or
Q) impersonate a KEYMER LTD employee or pretend to be one; or
R) attempt to gain administrative access and/or access restricted files and content.
7.2. Content that users post on our website and servers must not;
A) be vulgar, offensive, harassing or objectionable by reasonable standards; or
B) use or submit any material (including images) which is inappropriate, offensive, defamatory, vexatious or unlawful; or
C) use or submit any material or content on our website which infringes the intellectual property rights of a third party; or
E) Contain explicit sexual images and/or words of any kind.
F) transmit or upload any material that contains viruses, malware, spyware, or any other computer code.
A) personal injury or death resulting from our negligence; or
B) fraud; or
C) any matter which it would be illegal for us to exclude or to attempt to exclude our liability.
9.2. We are only liable to you for losses which you suffer as a direct result of our breach of these Terms and Conditions, and shall have no liability for any indirect or consequential loss or damage incurred by any user in connection with our website or in connection with the use, inability to use, or results of the use of our website, any websites linked to it and any materials posted on it.
9.3. You may have other rights granted by law, and these Terms and Conditions do not affect these except if the two are inconsistent. If this is the case then these Terms and Conditions will override any other rights which you may have, unless this is not permitted by law.
